Understanding Your Rights: What to Do if You’re Arrested?

Being arrested can be a frightening and confusing experience. However, knowing your rights and understanding how to respond can make a significant difference in protecting yourself and ensuring the best possible outcome. At Wilson Wong Law PC, we are committed to providing legal assistance to the California public and guiding individuals through the complexities of the criminal justice system.

Your Rights During an Arrest

If you are placed under arrest, you have specific legal rights that law enforcement must respect. These include:

  1. The Right to Remain Silent – Under the Fifth Amendment, you are not required to answer any questions from law enforcement officers. You can simply state, “I am exercising my right to remain silent.”
  2. The Right to an Attorney – You have the right to consult with a lawyer before speaking to the police. If you cannot afford an attorney, the court will appoint one for you.
  3. Protection from Unlawful Searches – Officers must have probable cause or a warrant to conduct a search, with some exceptions (such as evidence in plain view).

What to Do If You Are Arrested

To protect yourself and build the strongest possible defense, consider taking the following steps if you are arrested:

  1. Stay Calm and Comply with Law Enforcement – Resisting arrest can lead to additional charges. Stay composed and do not physically resist.
  2. Invoke Your Rights Clearly – Politely inform officers that you wish to remain silent and that you would like to speak with an attorney. Do not feel pressured into answering questions without legal counsel.
  3. Do Not Consent to a Search – Unless officers have a valid warrant or a legal exception applies, you have the right to refuse a search.
  4. Avoid Speaking About Your Case – Do not discuss your arrest with anyone other than your attorney. Conversations with law enforcement, cellmates, or family members may be used against you in court.
  5. Contact an Attorney Immediately – Legal representation is critical after an arrest. A skilled criminal defense attorney can evaluate your case, ensure your rights are upheld, and advocate on your behalf.
